Terms and Conditions

Introduction

 

We are The Bespoke Wardrobe (Essex) Ltd, a company registered in England and Wales. Our company registration number is ​​10665625 and our registered office is at Swift House Ground Floor, 18 Hoffmanns Way, Chelmsford, Essex, England. Our registered VAT number is 263964079.

 

These are the terms and conditions on which we, The Bespoke Wardrobe, supply products to you “the Customer”.

 

Please read these terms carefully before you place an order with us, as these terms will form a part of our legally binding contract.  By making a purchase or booking an appointment, you agree to these Terms and Conditions.  

 

Our Contract with You

 

Our acceptance of your order will take place when you have paid an agreed deposit and therefore at which point a legally binding contract will come into existence between you and us.

 

Nobody else has any rights under this contract. This contract is between you and us. No other person shall have any rights to enforce any of its terms.

Deposits and Cancellation

 

Deposits are non-refundable unless we cannot accept or fulfil your order. Deposits cannot be transferred to another person or item.

 

After your order has been accepted by us and a deposit has been paid, any items cancelled will be subject to the full amount being immediately payable and any monies already paid will not be refunded. We strongly recommend insurance is taken out for such unforeseen circumstances.

 

If we are unable to fulfil your order for whatever reason, including but not limited to,  discontinuation, unavailability, or because of an error in the price or description of the product or because we are unable to meet a delivery deadline you have specified in your original order, then you will be entitled to your money back and we will not be held liable for breach of contract, or compensation.

 

Appointment Policy

 

Appointments are required for in-store bridal consultations and fittings.  Please arrive on time for your scheduled appointment. If you are more than 15 minutes late, your appointment may be canceled or rescheduled.  Please do not arrive early as we could be with another bride and will be unable to accommodate you in store. We recommend bringing ideally no more than 3 to the first appointment.  

 

Product Availability

 

All products are subject to availability. If a product is out of stock or discontinued, we will offer you alternative options or a full refund.  Due to the nature of custom and made-to-order gowns, delivery times may vary.

 

Pricing

 

All prices are listed in GBP and include applicable taxes and all pricing will be stated on your order form.  

 

It is always possible that, despite our best efforts, some of the products we sell may be incorrectly priced. We will normally check prices before accepting your order so that, where the product's correct price at your order date is less than our stated price at your order date, we will charge the lower amount. If the product's correct price at your order date is higher than the price stated, we will contact you for your instructions before we accept your order. If we accept and process your order where a pricing error is obvious and unmistakeable and could reasonably have been recognised by you as a mispricing, we may terminate the contract, refund you any sums you have paid and require you to return the product at our expense.

 

Measurements

 

Once measurements and sizing have been taken for your order, we will not be held responsible for any weight loss/gain or any other changes in your measurements and sizing (for example due to pregnancy). If your measurements and sizing change it will be your responsibility to notify us, in which case we will confirm if we are able to make further alterations prior to delivery and what the estimated additional costs will be.

 

We will measure each Customer for each order and advise on the size to be ordered. If the Customer is not happy with the sizing they must inform us at the time of order. We will not be responsible for any sizing discrepancies after this time. 

 

If the Customer wishes to be measured at a later date it will be the Customer’s responsibility to ensure that such measurements are taken in good time for the products to be ordered and delivered in time and additional charges may be imposed (see “Additional Costs”).

 

Additional Costs

 

Orders for gowns, which are not of a standard length or measurement, may be subject to a surcharge, the amount of which may not be known at the point of order. A surcharge of up to 30% will apply for this requirement.

 

Alterations

 

Alterations are not included in the price of the gown unless stated otherwise.

 

Alterations will be done by Debbie, our in-house tailor and the cost will be quoted based on the required changes.

 

Alterations must be scheduled in advance. Tuile fitting if required will be 4-5 months before.  The first fitting is 8 weeks before the wedding.  The second fitting is 4 weeks before the wedding and the final fitting and collection is 2 weeks before.

 

Undergarments

 

We will not be responsible for any issue relating to unsuitable underwear being worn which may affect the structure of the dress, or shoes that may damage or affect the length of the dress.

 

Descriptions

 

Products may vary slightly from their pictures. The images of the products on our social media, on our website or in any other promotional material are for illustrative purposes only. Although we have made every effort to display the colours accurately, we cannot guarantee they accurately reflect the colour of the products. Your product may vary slightly from those images/samples.

 

Guidance

 

Where we provide guidance in the choice of design, size, colour and measurements we do so without any liability. All dresses, unless stated otherwise are ceremonial dresses only, and are to be used for ceremonial purposes.  

 

Payment Terms

 

Payment is due in full for all sample dresses at the time of purchase. 

 

For made-to-order or custom gowns, a deposit is required at the time of order and the balance must be paid at your first fitting approximately 8 weeks before your wedding date. We accept payment by cash, bank transfer or credit/debit card but do not accept payment by cheque.  Payment plans can be discussed if necessary.

 

We can charge interest if you pay late. If you do not make any payment to us by the due date, we may charge interest to you on the overdue amount at the rate of 5% a year above the base lending rate of HSBC bank plc from time to time. This interest shall accrue on a daily basis from the due date until the date of actual payment of the overdue amount, whether before or after judgment. You must pay us interest together with any overdue amount.

 

You will only own the product once we have received payment in full.  

 

The product will also be your responsibility when you collect it from us.

 

Storage Costs

 

Your gown will stay with us during the alteration process.  However if you have bought a sample and you would like us to store your gown we can at an extra cost.

 

If there is an accumulation of 3 or more months unpaid storage fees, then we will class this as abandoned goods. Products classed as abandoned will result in the Customer automatically losing ownership of such items.

 

In the unlikely event that any products are lost or damaged, due to fire, flood or theft, whilst on our premises we shall only be responsible for reimbursing the retail costs of such products.

 

End of Contract by Us

 

We may end the contract if you break it. We may end the contract at any time by writing to you if:

(a) you do not make any payment to us when it is due;

(b) you do not, within a reasonable time of us asking for it, provide us with information that is necessary for us to provide the products;

(c) you do not, within a reasonable time, allow us to deliver the products to you (if applicable) or collect them from us.

 

Third Party Services

 

We shall not be responsible for any services provided by a third party, whether or not such third party was recommended by us.

 

Privacy Policy

 

We respect your privacy and are committed to protecting your personal information. Your details will only be used to process orders, confirm bookings, and for communication purposes. We do not sell or share your personal information with third parties.

 

Liability

 

The Bespoke Wardrobe is not responsible for any injuries or accidents that occur in-store or at any events related to your purchase.  

 

We are also not responsible for delays or damages outside our control, including but not limited to, natural disasters, shipping delays, or manufacturing defects. If our delivery of the products is delayed by an event outside our control, then we will contact you as soon as possible to let you know and we will take steps to minimise the effect of the delay. Provided we do this we will not be liable for delays caused by the event, 

 

Governing Law

 

These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales. Disputes arising in relation to the same shall, unless otherwise expressly agreed, be subject to the exclusive jurisdiction of the courts of England and Wales.

 

Amendments to the Terms and Conditions

 

We reserve the right to update or modify these Terms and Conditions at any time. Any changes will be posted on our website, and it is your responsibility to review them regularly.
